On three separate times during the CO$TMarin webinar, one of the panelists, State Senator Mike McGuire, who was a co-author of SB9, stated that the new law allowed cities to deed restrict the new lot-split properties ‘in perpetuity’ to provide for ‘affordable housing.’

On November 1, 2021 at the Mill Valley City Council, Mayor John McCauley challenged the claims made by Sen. McGuire, expressing frustration with the ADU/SB9 legislation and concluded, “The state has been doing so much, so quickly they don’t know what the hell they’re doing.”

Because of poorly written bills, city councils and BOS across the state are spending 1,000’s of hours trying to understand and clean up sloppy, complex legislation that pours out of Sacramento year-after-year without conscience or accountability. Thoughtful City Council problem solving is replaced with callous bureaucrats in HCD.
